The Bench of Justice K. Vinod Chandran & Justice T. R. Ravi in its order remarked “The Government and the Board were well aware of the pandemic situation, when a decision was taken to permit congregation in a religious place; especially at Sabarimala where there is an arduous trek to reach the sanctum sanctorum.” Further the court said, “We would think and hope that necessary precautions are in place, without need to resort to measures which would lead to lasting environmental degradation; as in the case of the reintroduction of plastics.” The matter before the Court On Sabarimala Special Commissioner’s report regarding the necessity of relaxation to certain essential plastic items to protect against COVID-19 pandemic from the complete ban of plastic in and around Sabarimala, the Kerala High Court initiated Suo Moto proceeding. The prayer of the Sabarimala Special Commissioner was to temporarily lift the ban on plastic imposed in and around Sabarimala by two orders of the Court in the year 2015 and 2018. The ban on plastic was introduced in the year 2015 and reiterated in the year 2018 by this Court. The Special Commissioner in the instant report sought for re-introducing this environmental scourge into Sabarimala; temporarily, in the times of the pandemic. It was requested that face-shields masks, gloves and hand sanitizers in plastic bottles be permitted for the current Mandala Makaravilakku Season commencing on 15.11.2020, on a review of the earlier orders. It was also prayed that the Devaswom Board and the Sabarimala Sanitization Society be directed to collect, segregate and dispose of the plastic items in a scientific manner. Court’s Observations While taking into account various news reports, the Court noted that there is large scale pollution even in remote Mount Everest and that tiny pollutant are found at heights of 8,440 metres above sea level with higher concentrations at the base camp. In this context, the Court said, “Only less than thousand scale Mount Everest every year that too for a short period, which itself has created the scourge referred to earlier. Sabarimala in comparison to Mount Everest, is much smaller in area, but with far more footfalls throughout the year than Mount Everest.” The Court observed that the pandemic situation has shaken the entire world upsetting the social norms passed down over centuries and had for a time brought human activity across the planet to a standstill. “Though the Governments have lifted the lock-downs imposed; unprecedented in the history of mankind, the virus has not left us in peace”, said the Court. Regarding the Commissioner’s report, the Court said, “We perfectly understand the anguish of the Special Commissioner in having sought for review of the earlier orders in the context of the spread of the pandemic. However, the virus has been generally understood to be not here to stay and preventive measures are vigorously pursued with the hope of a vaccine being developed immediately. Plastic, being not biodegradable, on the other hand, due to its use and abuse by mankind, is here to stay.” When the Standing Counsel for the Devaswom Board specifically sought for such permission, at least for the staff and employees posted at Sabarimala with strict monitoring of the disposal, the Court said “Monitoring and disposal, of the masks, gloves face shields and plastic bottles used even by the employees, are downright impossible; especially given the predilection of humankind to use the whole of the earth; except their homes as a dumping ground” Lastly, the Court also said, “It is to be remembered that we, who now inhabit this planet, hold nature and its bounties in trust for the generations to come. We find it impossible to review the orders passed and respectfully re-affirm the same.”Subscribe to LiveLaw, enjoy Ad free version and other unlimited features, just INR 599 Click here to Subscribe. Lakers’ Kobe Bryant says ‘he feels good’

first_imgSomething looked remarkably different on the Lakers’ practice floor Tuesday, and it didn’t just involve Kobe Bryant’s presence. It also involved the way he played the game.In the 20 minutes of practice open to the media, Bryant didn’t take a single outside shot. His lone basket was a fast-break dunk following a steal, but other than that Bryant mostly passed the ball.“Get that on tape will you? That won’t happen a lot,” Lakers coach Mike D’Antoni joked. “He does that in practice sometimes. He goes back and forth. He can get a shot when he wants to.” Whether Bryant wanted to stay cautious on his left Achilles tendon remains unclear. He didn’t speak to reporters after practice, but later Tuesday at a Turkish Airline event at a Manhattan Beach hotel Bryant provided little clarity on his progress.“I feel good,” Bryant said. “I feel good.”Will that be enough for him to return when the Lakers (9-9) play the Sacramento Kings (4-11) on Friday at Sleep Train Arena?“We don’t want to jump the gun,” D’Antoni said. “We don’t know. Obviously we have to see how he feels tomorrow and if he practices tomorrow. Obviously we have to see how he feels Thursday and practice Thursday.“We’ll see if he’s able, but today he looked good.” Lakers guard Steve Nash called it “unlikely” and “very doubtful” he would play Friday against the Kings. After spending the last week in Vancouver with his personal trainer, Rick Celebrine, to heal nerve issues in his back Nash practiced Tuesday in full-court five-on-five drills for only 10 minutes. He left the floor by the time the Lakers opened practiced to the media.D’Antoni said he limited Nash’s time as a precaution and plans to increase his workload today and Thursday. But even with Lakers backup guard Jordan Farmar sidelined for about a month because of a strained left hamstring, Nash said he won’t expedite his return. He had averaged only 6.7 points on 26.1 percent shooting and 4.8 assists in 22.5 minutes before sitting out the past 10 games. The Lakers have an open roster spot, but they don’t plan to add another point guard because they hope Nash will return soon and Steve Blake’s hyperextended right elbow won’t be an issue.“I don’t know about a quick comeback, but I was encouraged to practice today some and feel OK,” Nash said. “I have no doubt I’ll get back on the court. With all the issues with my spine and condition, it’s a matter of how sustainable it is. I’m working every day to try to build that quality, endurance and movement so I don’t decline and I’m not susceptible to all the demands of the game.”Meanwhile, there was plenty of attention paid to Bryant’s every move.Lakers general manager Mitch Kupchak, trainer Gary Vitti and team doctor Steve Lombardo watched the team’s practice. Bryant’s return to practice also sparked a large media contingent, including reporters from Chinese Central Television (CCTV). Bryant scrimmaged with Pau Gasol, Jordan Hill, Wesley Johnson and Blake. Guard Jodie Meeks mostly guarded Bryant, who struck a good balance between aggressiveness and cautiousness with his movement. Meanwhile, Bryant’s passing accuracy featured hits and misses. Some of Bryant’s passes were either deflected or sailed wide. But he also threw a no-look pass to Shawne Williams for a baseline jumper and connected with Johnson on a three-pointer. Bryant also set up Gasol on the elbows, something they’ve mostly run well during their past 5 1/2 seasons together with the Lakers. Bryant exchanged high-fives with Gasol after a few made jumpers.“He looked pretty good, real good actually,” Gasol said. “You can tell he’s been working a lot on his own and is in a really good rhythm and he knows what he’s doing out there.”Still, challenges likely await for whenever Bryant ultimately plays in his first game since shattering his Achilles seven months ago.“We want Kobe to be Kobe,” D’Antoni said. “He won’t change his game up for us.“We’ll adjust where we have to, and he’ll figure out what needs to be done.”center_img Newsroom GuidelinesNews TipsContact UsReport an Errorlast_img read more

Number of school children missing class at record high, new figures show

first_imgThe number of pupils missing school across the country on a regular basis had hit record highs, new figures show. It is understood the numbers, released by Tulsa, is due to the rising numbers of homeless children, insufficient numbers of staff, and increasingly complex cases such as students with mental health issues and special needs.According to the Irish Examiner, figures contained in the child and family agency’s most recently published monthly report show that in April, Tusla’s Educational Welfare Service (EWS) had 2,636 referrals on its waiting list. The figure has been climbing steadily since last October and the comparable figure from April 2018 was 1,670 cases. In addition to the all-time high number of referrals on its waiting list last April, the number of cases closed that month — 275 — was the lowest monthly tally so far this year. Yet the number of referrals screened that month was amongst the highest recorded in 2019.Tusla said the EWS — which issues School Attendance Notices (SANs) to parents in relation to excessive absenteeism by children from school, and which can and does bring prosecutions to court — only started recording the number of cases on a national waiting list in September 2017, and the figure for April 2019 is the highest recorded since.“There are a number of reasons for the growing waiting list including staffing, the complexity of cases and rising referrals,” said a spokesperson for Tusla.Overall, staffing at the EWS, while increasing, “is still below what is required to meet service demand.” Number of school children missing class at record high, new figures show was last modified: July 14th, 2019 by Shaun KeenanShare this:Click to share on Facebook (Opens in new window)Click to share on Twitter (Opens in new window)Click to share on LinkedIn (Opens in new window)Click to share on Reddit (Opens in new window)Click to share on Pocket (Opens in new window)Click to share on Telegram (Opens in new window)Click to share on WhatsApp (Opens in new window)Click to share on Skype (Opens in new window)Click to print (Opens in new window)last_img read more

Community Focus: Glenties Cardiac First Responders group shows it has real heart

first_imgGlenties Cardiac First Responders (CFR) is a newly formed group made up of local volunteers that are trained to assist in the event of emergencies such as Cardiac Arrest. Here secretary of GCFR, Susan O’Donnell, explains the aims of the group and why they are looking for new volunteers. Our aim is to be able to respond to emergency calls in Glenties and its surrounds (to a radius of 8km) as deemed appropriate by the National Ambulance Service (NAS). A team will be dispatched carrying a mobile defibrillator with the possibility that they could be on scene attending to a patient within minutes whilst waiting for an ambulance which we know in rural Donegal can unfortunately, take anything from 20 minutes to an hour.Like many other towns in the country, Glenties is working hard to fully establish this service and join those already in existence. On 1st August 2019, Ardara Cardiac First responders celebrated the 1st Anniversary of their existence.  They have been an enormous help to us in every way from the provision of training, lending of equipment, assistance with administration and imparting their acquired experience from their first year in operation. We would like to extend a heartfelt ‘Thank you’ to Teague McFadden and the Ardara Group for their kindness and generosity.  Your support has been and continues to be invaluable. Presently, our Glenties group has 24 trained members with a number waiting in the wings for the next training session.  This training includes CPR (compressions and ventilation), recognising the signs of stroke, how to deal with a choking incident and intervening in an array of other life-threatening conditions.  In addition to the training delivered previously by the Ardara CFR group, we are fortunate to have AJ Gallagher on board to train both new members and to deliver refreshers every month.Ultimately, we would endeavour to have defibrillators installed outside every Primary School in the area as well as other units strategically placed within the 8km specified zone.Presently the area has three defibrillators.  Provision of additional defibrillators will mean that when someone is in need of this intervention, they will only be a few minutes away from their nearest unit, enhancing the ‘Chain of Survival’ and increasing the victim’s survival rate by 7% to 10%.The cut-off points within the 8km recommended radius are: Donegal Road (R262) intersection with Thower Crossroads, Ardara Road (N56) turn off to Glenconwal where we overlap with the Ardara Cardiac First Responders, Narin Road (R261) at Ballyeriston, Dungloe Road (N56) at Gweebarra Bridge, Fintown Road (R250) at Pairc Achla and Glen Road (R253) at Lough Ea.Anyone who is living in these areas and feels they would like to join with the group and potentially help save the lives of family members, neighbours and friends, please contact Anne (089 9746050), Brian (087 9354012), Colleen (086 3585564) or Susan (086 1798692).  You can also send us a message on Facebook and perhaps give us a wee ‘like’ so we can spread the word.  Simply type in ‘Glenties Cardiac First Responders’ and you should find us. During the initial set up process, fundraising has been a huge aspect of our focus.  In order to get up and running and ‘go live’ with the NAS, we must first have the required equipment. The potential cost of set-up is in the region of €4,000 and moving forward, if we are to purchase additional defibrillators the predicted cost would be in the region of €10,000.  Unfortunately, a number of applications submitted to state agencies were unsuccessful and this has been a set back to our efforts.Thankfully, our members are a determined bunch and we have put in huge efforts to raise necessary monies to realise our aim.  To date, we have received donations from various individuals and groups in the town of Glenties and we are so grateful for their generous contributions.  Tír Conaill GAP Cycling Club donated €750 from their Easter Charity Ride, €500 was received from a Mental Health Awareness Day co-ordinated by Edeninfagh NS and involving the pupils from St Riaghan’s NS Drimnacrosh, Fintown NS, Meenagowan NS Lettermacaward and Doochary NS, €1,100 was raised by Gemma O’Donnell, Glen Road for her 21st Birthday and just recently our first Church Gate Collection in Glenties and Edeninfagh yielded a massive €1,025.A number of businesses in the town have been extremely supportive and have offered to purchase a defibrillator for our use.  We will be in touch with them soon to further discuss their generous offers.  For these and all contributions thus far, we are truly humbled and grateful. It is our dream to be up and running in early September.  Working in teams, we will initially provide cover from 7p.m. to 7a.m. responding to ambulance call-outs.This means that if an ambulance is called from anywhere within the 8km radius, the on-duty team will be notified and dispatched to the address of the patient.  Trained personnel will endeavour to be on scene within minutes of the call being received to help and offer reassurance to the patient and family members.  After entering the house, a brief assessment of the overall situation will be carried out by the CFR team and following proper procedure they will carry out appropriate intervention on the patient, continuing until the ambulance and its crew arrives.Upon arrival of the Ambulance Crew, the CFR team will give a quick briefing and hand over the patient.  As an example of the success of Community First Responder Groups, Ardara CFR were called out 49 times in their first year.  There is no doubt that this service saves lives!Moving forward, in the coming months we intend carrying out further fundraising.  If we are to have Glenties and its surrounds fully equipped with defibrillators, recruit and train new members and pay for the upkeep of our initial equipment, then it is vital that we have funds at our disposal. To this end we will be out and about raising funds and raising awareness.  If anyone has an idea that they would like to share with us regarding fundraising, please feel free to contact a group member.  All ideas welcome! We would also love to see new faces joining us on the team.  Training takes place locally and is delivered in a friendly and coherent manner.  You will be joining like-minded enthusiastic locals who just want the best for their community. Why not arm yourself with the knowledge and skills to save a life should the need arise?  Please get involved!  No team member will ever be sent to a call-out alone and you will always receive support, before, during and after an event. What are you waiting for – please contact one of the contacts previously mentioned and don’t forget our Facebook page!Community Focus: Glenties Cardiac First Responders group shows it has real heart was last modified: August 23rd, 2019 by Staff WriterShare this:Click to share on Facebook (Opens in new window)Click to share on Twitter (Opens in new window)Click to share on LinkedIn (Opens in new window)Click to share on Reddit (Opens in new window)Click to share on Pocket (Opens in new window)Click to share on Telegram (Opens in new window)Click to share on WhatsApp (Opens in new window)Click to share on Skype (Opens in new window)Click to print (Opens in new window)Tags:cardiacdonegalfirst responders groupGlentieshealthlast_img read more

OPENapps Launches Web App Marketplace to Bring Together Developers and Website Owners

first_imgTags:#start#startups OPENapps, a marketplace for web applications, launches its beta service today. OPENapps allows app developers to easily get their application to market and provides website owners a way to find and integrate apps into their sites while still maintaining their own branding.According to Joseph Puopolo, Director of Marketing and Community for the Toronto-based startup, OPENapps addresses two issues in the web apps marketplace: First, site owners, particularly small and medium-sized businesses, want to have advanced functionality on their websites but often have neither the time, technological resources, nor money to implement them properly. And second, web app developers often feel compelled to choose a single platform on which to develop their apps and struggle to both market and monetize their applications. While there are several other major app marketplaces, with Google announcing plans for an app store at Google I/O last month for example, Puopolo stresses the importance of being “platform agnostic.” To that end, OPENapps will not restrict developers to a single platform or language. “Develop once in your preferred language, and it’ll work on every web publishing platform – Drupal, Joomla, WordPress, Moveable Type and others. There’s no longer any need to make tough platform choices when building your web application.”The benefits for website owners are clear as well, as the apps can be skinned to match a website’s branding and look and feel, avoiding what Puopolo calls the “inelegant solution” of iframes.“There is a general sentiment out there that people are looking for an easier way to deploy applications on a website and developers are looking for better ways to develop and sell their applications to a broader audience” says Adam Sadowski, President of OPENapps. As web apps continue to be touted as “the future,” OPENapps hopes to be able to help developers find a market for their apps and help website owners easily implement them.
